These Terms of Service govern your use of Tastyful, a service provided by Auxilery LLC. By using Tastyful, you agree to these Terms.
1. The service
Tastyful is a personal food diary that helps users record meals, receive estimated nutrition information, view trends, and use related sharing or export features. Auxilery LLC may add, remove, or change features over time.
2. Eligibility and accounts
You must be legally able to agree to these Terms. If you use Tastyful on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for the activity on your account and for keeping access to your account secure. Information you provide must be accurate and current.
3. Nutrition and health disclaimer
Tastyful provides estimates for general informational purposes only. Food identification, portion sizes, calories, macronutrients, and other results may be inaccurate or incomplete. Tastyful is not a medical device or healthcare provider, and Auxilery LLC does not provide medical, nutrition, diagnosis, or treatment advice. Do not rely on Tastyful for medical decisions, allergy safety, or emergency needs. Consult a qualified professional for advice specific to you.
4. Your content
You retain ownership of meal descriptions, photos, and other content you submit to Tastyful. You grant Auxilery LLC a limited, worldwide license to host, store, copy, process, and display that content only as reasonably necessary to operate, secure, and improve Tastyful and provide features you request. You represent that you have the rights needed to submit your content.
5. Acceptable use
You may not misuse Tastyful. For example, you may not:
- Break the law or violate another person’s rights.
- Upload malicious code or content that is unlawful, harmful, or infringing.
- Attempt to access accounts, systems, or data without authorization.
- Interfere with the service or bypass usage, security, or access controls.
- Use automated means to scrape, overload, or reverse engineer the service except where applicable law permits it.
6. Auxilery LLC property
Tastyful, including its software, design, branding, and service content other than your content, is owned by Auxilery LLC or its licensors and is protected by applicable intellectual-property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use Tastyful for its intended purpose.
7. Third-party services
Tastyful may rely on or link to third-party services. Those services may have their own terms and privacy policies. Auxilery LLC is not responsible for third-party services that it does not control.
8. Beta service and changes
Tastyful may be offered as a beta or early-access service. Features may be incomplete, change without notice, or occasionally be unavailable. Auxilery LLC may suspend, limit, or discontinue all or part of Tastyful at any time.
Subscriptions and complimentary access
Tastyful Plus offers monthly and annual auto-renewing subscriptions. The applicable price, currency, billing period, and included features are shown before purchase. Annual plans are billed in advance for the full year. Payment is charged to your Apple or Google Play account when you confirm the purchase. Subscriptions renew automatically unless you cancel renewal before the current subscription period ends. You can manage or cancel your subscription in your store account settings. Cancellation normally leaves access available until the paid period ends; refunds are handled under the applicable store policies and your statutory rights.
The initial allowance of 10 free meal generations does not require payment details and does not automatically start a subscription. Daily generation limits apply to Plus as described in the app. Meal history and reuse of saved meals remain available without an active subscription. Complimentary access may be granted, expire, or be revoked separately from a subscription; receiving a gift does not cancel an existing subscription or its renewal.
Deleting Tastyful or your Tastyful account does not cancel your store subscription. Cancel renewal through Apple or Google Play before deleting your account if you no longer want to be charged.
9. Suspension and termination
You may stop using Tastyful at any time. Auxilery LLC may suspend or terminate access if you violate these Terms, create risk for the service or others, or if the service is discontinued. Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers
To the fullest extent permitted by law, Tastyful is provided “as is” and “as available.” Auxilery LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.
11. Limitation of liability
To the fullest extent permitted by law, Auxilery LLC and its members, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to Tastyful. Auxilery LLC’s total liability for any claim relating to Tastyful will not exceed the amount you paid Auxilery LLC for Tastyful during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Changes to these Terms
Auxilery LLC may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. By continuing to use Tastyful after updated Terms take effect, you agree to the revised Terms.
13. General terms
These Terms and the Privacy Policy are the entire agreement between you and Auxilery LLC regarding Tastyful. If any provision is unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without Auxilery LLC’s consent; Auxilery LLC may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. Applicable law governs these Terms.
